Landmark Court Ruling in Campobasso Strengthens Path to Italian Dual Citizenship for Italian Americans

On May 1, 2025, the Court of Campobasso ruled there can be no retroactive application of the Tajani Decree, which aimed to limit Italian Dual Citizenship to just two generations born abroad. 

While the case involved was filed before the March decree, the ruling addressed the general principle of retroactivity as being in conflict with Article 11 of the Pre-Laws of the Italian Civil Code. 

This is an important ruling that could be an indication of how the Italian courts will handle the more complex question: the legality of a law retroactively affecting ius sanguinis (right of blood) of those born with Italian citizenship rights. 

This was a major win for those who began their application before March 28, 2025 – and it presents another reason for optimism for those currently disqualified who would like to apply for Italian dual citizenship in the future.
